1. Scope
These terms and conditions apply to all orders for plants placed via the order form provided on this website.

2. Contract Conclusion
The presentation of the plants offered does not constitute a legally binding offer.

By submitting the order form, you are making a request to purchase the selected plants.
A binding purchase agreement only comes into effect when we expressly confirm your order.

3. Pricing
All prices are in euros and include the applicable statutory value added tax (currently 7%).

4. Payment methods
Payment is made after order confirmation.

CUSTOMERS IN GERMANY: You have the option to choose between the following payment methods:

• Advance payment to the account of Dr. Heinrich Beyrle, Commerzbank, IBAN DE51 7204 0046 0122 2322 00
• Paypal: heinrich.beyrle@t-online.de
• Advance payment by direct debit
• Cash on delivery – you pay upon delivery of the ordered goods.

CUSTOMERS ABROAD: You have the option to choose between the following payment methods:

• Advance payment to account holder: Dr. Heinrich Beyrle, Bank name: Commerzbank, IBAN DE51 7204 0046 0122 2322 00, BIC: COBADEFFXXX
• If you choose to make an advance payment to our account, please ensure that all bank charges (your bank's charges as well as the charges of the other bank) are borne by you.

• Advance payment via international postal order
• or an individually agreed payment method

You will receive the payment information with the confirmation of your order.

5. Versand, Lieferzeit und Versandkosten
Der Versand erfolgt in der Regel in den Monaten Juni bis Oktober, abhängig von Witterung und Pflanzenzustand.

Delivery is subject to availability.

We charge €6 for postage and packaging within Germany and €8 within the EU. For international shipping, costs vary depending on the destination country.

6. Minimum order value
The minimum order value is €20.00.

7. Availability and alternatives
Should individual plants be unavailable, we reserve the right to:

• to partially execute the order or
• to suggest suitable alternatives

Payments already made will be adjusted accordingly or refunded.

8. Special features of plants (natural products)
The plants offered are predominantly grown from seeds and are natural products.

Variations in size, growth form, flowering behavior and color nuances are possible and do not constitute a defect.

A complete guarantee of exact varietal purity cannot be given in individual cases.

9. Shipping and Transfer of Risk
Shipping is carried out with the utmost care.

The risk of transport passes to the buyer upon handover of the goods to the shipping company, provided this is legally permissible.

10. Place of jurisdiction
The place of jurisdiction is Augsburg, insofar as legally permissible.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you have taken possession of the goods.

To exercise your right of withdrawal, you must inform me (Dr. Heinrich Beyrle, Lindenmahdstrasse 19, 86391 Stadtbergen, heinrich.beyrle@t-online.de) of your decision to withdraw from this contract by means of a clear statement (e.g. by email or letter).

Consequences of withdrawal
If you cancel this contract, we will reimburse all payments received from you (including delivery costs) without undue delay and at the latest within fourteen days from the day on which we received your cancellation notice.

For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise.

We may refuse to refund your money until we have received the goods back or you have provided proof that you have returned the goods.

You must return the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal.

You are responsible for the return shipping costs.

Note regarding living plants
Please note that the plants supplied are living, delicate natural products.
Returns should therefore be handled carefully and promptly to avoid damage.
